Oracle CEO Ellison to testify Monday in SAP trial

Oracle Corp Chief Executive Larry Ellison, Silicon Valley's richest man, is expected to testify on Monday in a high-profile software theft trial against Germany's SAP, an Oracle attorney said.

Europe's largest software maker has agreed to pay Oracle $120 million in return for a promise by the U.S. company to not seek punitive damages, sources say.

SAP, which reported profit just shy of $1 billion in its most recent quarter, has admitted fault in the case and says it had been unaware of the violations. It has shut down its TomorrowNow subsidiary, which improperly downloaded millions of files from Oracle's customer service website.
